Who bears responsibility for the product?
As of January 1, 2009 the 5th amendment of the German Packaging Ordinance has come into force according to which producers and distributors of sales packaging filled with goods that typically end up with private consumers are obliged to participate in a dual system with these sales packaging.
By participating in the dual system of Duales System Deutschland GmbH you may comply conviently and in accordance with law with the requirements of the German Packaging Ordinance.
Who is responsible for the participation in a dual system?
- For industrially filled packages, the first dealer will usually be responsible for the proper participation in a dual system.
- For service packages like carrier bags, paper bags, wrapping films and disposable cups/plates, etc., which are only filled in the shop itself, responsibility will usually be vested in the last dealer, for example the retailer involved.
- For imported goods, it has to be considered that the first dealer according to the German Packaging Ordinance is the party which executes the transport of the goods across the border to Germany. As the case may be, either the foreign exporter or the German importer is obliged to participate in a dual system.
By concluding a participation contract you, as the company responsible for the product, fulfill your obligations of the Packaging Ordinance. The Green Dot on your sales packaging indicates the final consumer that you take your producer’s responsibility seriously.
