Supplementary agreement 2003 for implementing the ruling of the EU Commission dated 20 April 2001

According to § 4 Paragraph 1 of the Trademark Contract, licensees have to pay a licence fee to Duales System Deutschland GmbH for all the packaging they have labeled with the Green Dot trademark and sold on the territory of the Federal Republic of Germany. Exceptions to this require a separate written agreement.
In a ruling dated 20 April 2001, the European Commission has instructed DSD GmbH to provide for an exception of this kind for two tightly delimited case groups. Pending clarification of the legal position in the courts, the Commission’s ruling will be implemented, following consultations with the Commission, by a supplementary agreement to the Trademark Contract:
Every licensee who - in the two case groups covered by the Commission’s ruling for packaging labeled with the Green Dot trademark - does not wish to pay the licence fee provided for in § 4 Paragraph 1 of the Trademark Contract has to conclude this supplementary agreement.
