Several companies have lodged a complaint with the Federal Constitutional Court in Karlsruhe regarding the Disposable Plastics Fund Act (EWKFondsG), reports the specialist journal Euwid Recycling. Companies that place certain single-use plastic products on the market in Germany must register with the Federal Environment Agency and pay into a fund to cover the costs of collection in public collection systems, cleaning and awareness-raising measures.
The plaintiffs – manufacturers of the products affected by the law – now see their professional freedoms and financial constitutional provisions of the German Basic Law violated. In their view the conditions for levying a special levy are not met.
