A key topic for all – the new German Packaging Act

The new German Packaging Act will come into effect on 1 January 2019 and forces all producers and distributors to take action.

The new Packaging Act was approved by the German Federal Council in May and announced in the Federal Law Gazette yesterday. It is thus settled that the essential provisions will come into force on 1 January 2019.

As a result all companies distributing packaged goods on the German market – also online distributors – have to act. We have summarized the most important modifications for you. As a matter of course we will continuously keep you informed about the consequences of the new German Packaging Act for your company. 

  • All manufacturers will in future be obliged to register online with the Central Body for Registry before circulating packaging on the German market (§9 Packaging Act). 
  • The Central Registry will publish registered manufacturers on the Internet.
  • Manufacturers who are not registered are not allowed to distribute sales packaging which has to participate in a take-back system. This packaging always had and still has to take part in a dual system.
  • The obligation to participate in a system applies for sales packaging, service packaging, dispatch packaging and secondary packaging.
  • All information concerning the quantity and material of the packaging etc. must be reported to the Central Body without delay.

The registration portal of the Central Body is still under construction. We will inform you as soon as the registry is possible.

Important notice for online retailers: The Packaging Act clearly defines dispatch packaging as sales packaging which must be registered for a take-back system by their distributor. The participation of dispatch packaging cannot be provided by the pre-distributor. This means: Each online retailer is obliged to have his dispatch packaging participate in a dual system by himself.
