On July 1, 2022, manufacturers will be subject to new obligations under the German Packaging Act: anyone who places commercially packaged goods on the market in Germany must have registered with the LUDID packaging register by this date. The type of packaging is irrelevant and therefore also whether or not there is an obligation to participate in the system.
Attention – important: Companies must register sales, repackaging and shipping packaging in the same way as transport packaging, reusable packaging, industrial packaging, deposit-required disposable beverage packaging, etc.
The new registration regulations also affect final distributors of service packaging who have delegated their obligations in full to a pre-distributor. In the event of violations, there is a ban on distribution. To give affected companies sufficient notification time, the ZSVR LUCID opens for this purpose on May 4, 2022.
Changed obligations also apply to electronic marketplaces for private end consumers. Only LUCID-registered and system-participating traders and sellers will be allowed there on July 1, 2022. Platforms are required to verify this. Likewise, fulfillment service providers must ensure that their principals comply with packaging law obligations. If this is not the case, fulfillment service providers will no longer be allowed to offer their services.
The ZSVR wants to make it easier for electronic marketplaces and fulfillment service providers to fulfill their inspection obligations and has announced that it will make an XML file available on a daily basis starting in June 2022 with the option of a register retrieval.
