All sales packaging and secondary packaging that is passed on to the private final consumer is considered to be packaging subject to system participaton.
This means that it must participate in the collection and recovery system of a dual system. What does this mean for intermediaries? Who must participate this packaging? The producer or the distributor?

Responsibility for the participation of packaging subject to the system participation lies with the person who first places the filled packaging on the German market (usually the manufacturer). I participate the packaging components that I add myself before they are passed on to the private final consumer.
If I import packaged goods from abroad, I am generally obliged to participate the packaging components in the collection and recycling system of a dual system that are passed on to the private final consumer via the supply chain, if I am legally responsible for these goods when they cross the border.
