I have received an e-mail from the Central Agency Packaging Register (ZSVR) about an alleged violation of the German Packaging Act - what do I have to do?

The Central Agency Packaging Register (ZSVR) has launched a mail campaign to several thousand companies registered in LUCID as producers of packaging subject to system participation, but for which no system and producer data reports are available.

The background to this is the producer's obligation under packaging law not only to register in LUCID but also to conclude a fee-based participation contract with a (dual) system such as Der Grüne Punkt. The packaging quantities placed on the market per material fraction to be settled here must then be declared by the producer subsequently in LUCID as a data report. This enables the ZSVR to carry out a quantity comparison between the producer's declaration and the system's declaration on the basis of the registration number.

 

At present, however, thousands of producers registered in LUCID are missing this information, which leads to the suspicion that no corresponding participation contracts have been concluded and that free riding is taking place.

 

For all those who have already received an e-mail or would like to check the facts, the following should be done:

  • Check whether there is a valid participation agreement ("licence agreement") with a (dual) system such as Grüner Punkt.

  • Ensure that your LUCID registration number is (correctly) deposited with your chosen (dual) system.

  • Participation contract in place and LUCID registration number deposited with your (dual) system?
    » Then all that remains is to report your packaging quantities to LUCID in the same way - and your obligations under the Packaging Act are fulfilled. To do this, log into the LUCID packaging register with your login.
